SOCIAL WELFARE (CONTRIBUTIONS) (AMENDMENT) REGULATIONS, 1977.

The Minister for Social Welfare, in exercise of the powers conferred on him by sections 3 , 7 and 9 of the Social Welfare Act, 1952 (No. 11 of 1952) hereby makes the following Regulations:—

1. (1) These Regulations may be cited as the Social Welfare (Contributions) (Amendment) Regulations, 1977.

(2) The Social Welfare (Contributions) Regulations, 1953 to 1976 and these Regulations may be cited collectively as the Social Welfare (Contributions) Regulations, 1953 to 1977.

2. In these Regulations—

"the Act" means the Social Welfare Act, 1952 (No. 11 of 1952);

"the Principal Regulations" means the Social Welfare (Contributions) Regulations, 1953 ( S.I. No. 5 of 1953 );

"the Regulations of 1961" means the Social Welfare (Contributions) (Amendment) Regulations, 1961 ( S.I. No. 139 of 1961 );

"the Regulations of 1970" means the Social Welfare (Contributions) (Amendment) Regulations, 1970 ( S.I. No. 222 of 1970 ).

3. Article 3 of the Social Welfare (Contributions) (Amendment) Regulations, 1975, ( S.I. No. 84 of 1975 ) and article 3 of the Social Welfare (Contributions) (Amendment) Regulations, 1976, ( S.I. No. 101 of 1976 ) are hereby revoked.

4. (1) Subject to sub-articles (2) and (3) of this article, sub-article (1) of article 13A (inserted by the Regulations of 1961) of the Principal Regulations shall be construed in the case of a person who attains the age of 57 years on or after the 1st day of July, 1974, as if "the age of fifty-eight" were substituted for "the age of sixty".

(2) Subject to sub-article (3) of this article, sub-article (1) of the said article 13A shall be construed in the case of a person who attains the age of 56 years on or after the 1st day of April, 1975, as if "the age of fifty-seven" were substituted for "the age of sixty" and sub-article (1) of this article shall not apply in the case of such a person on his attaining the age of fifty-seven years.

(3) Sub-article (1) of the said article 13A shall be construed in the case of a person who attains the age of 55 years on or after the 1st day of October, 1977, as if "the age of fifty-six" were substituted for "the age of sixty" and sub-article (2) of this article shall not apply in the case of such a person on his attaining the age of fifty-six years and sub-article (1) of this article shall not apply in the case of such a person on his attaining the age of fifty-seven years.

5. The amount of a contribution in respect of old age (contributory) pension to be returned to an insured person under sub-article (1) of article 13A of the Principal Regulations in respect of a contribution week commencing on or after the 4th day of April, 1977, shall be—

(i) in respect of an employment contribution paid under paragraphs 1, 3A, 6 or 7 of the Second Schedule to the Act

(ii) in respect of an employment contribution paid under paragraphs 2, 2A, 3 or 8 of the Second Schedule to the Act

(iii) in respect of a voluntary contribution paid at the rate of three pounds and ten pence

(iv) in respect of a voluntary contribution paid at the rate of one pound and ninety pence

6. The amount of a contribution in respect of retirement pension to be returned to an insured person under sub-article (1) of article 13D (inserted by the Regulations of 1970) of the Principal Regulations in respect of a contribution week commencing on or after the 4th day of April, 1977, shall be—

(i) in respect of an employment contribution paid under paragraphs 1, 2, 2A, 3A, 6 or 7 of the Second Schedule to the Act

(iii) in respect of a voluntary contribution paid at the rate of three pounds and ten pence

EXPLANATORY NOTE.

The Social Welfare Act, 1977 , provides for new rates of social insurance contributions. These Regulations determine the amounts of the new rates paid in respect of retirement and old age (contributory) pension to be returned to a person who entered insurance after the prescribed age and who was not insured before that age under the former National Health Insurance Acts. The prescribed age is fifty-five for retirement pension purposes. In the case of old age (contributory) pension, the prescribed age is sixty for persons born before 1 July, 1917, fifty-eight for persons born in the period from 1 July, 1917, to 31st March, 1919, fifty-seven for persons born in the period from 1 April, 1919, to 30 September, 1922, and fifty-six for persons born on or after 1 October, 1922.
