TELECOMMUNICATIONS (AMENDMENT) (No. 2) SCHEME, 1994.

BORD TELECOM ÉIREANN in exercise of the powers conferred on it by Section 90 of the Postal and Telecommunications Services Act, 1983 (No. 24 of 1983) hereby makes the following Scheme:

1. This scheme may be cited as the Telecommunications (Amendment) (No. 2) Scheme, 1994.

2. The collective citation "the Telecommunications Schemes, 1994" includes this scheme.

3. (i) This Scheme in so far as it specifies tariffs in respect of the Integrated Services Digital Network Facility, shall be deemed to have come into operation on 1 February 1994.

(ii) This Scheme in so far as it provides for matters other than those mentioned in paragraph (i) of this Article shall come into operation on 1 September, 1994.

4. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Scheme.

5. The Minister for Communications, pursuant to Section 90 (2) of the Postal and Telecommunications Services Act, 1983 (No. 24 of 1983), has concurred in the increase of charges effected by this Scheme.

6. The Telecommunications Scheme, 1994, ( S.I. No. 177 of 1994 ) is hereby amended by:

( a ) the substitution of the following Article for Article 103:

"103. (1) An Eirpac subscriber shall pay to Bord Telecom Éireann in respect of any Eirpac call or attempted Eirpac call originating from or on equipment or apparatus under his control Eirpac call charges calculated with reference to:

( a ) the volume of data passed through and measured in units (each capable of containing sixty-four characters of data including non-alphanumeric characters and spaces, and known as segments) determined and recorded by the packet switching exchange and not by reference to the volume of data originated and received by the subscriber's equipment and apparatus; and

( b ) the duration of the Eirpac call determined and recorded by the packet switching exchange.

(2) The charges applicable to the volume and duration referred to at (a) and (b) respectively of paragraph (1) above are set forth in the Fourth Schedule to this Scheme. Such charges shall be calculated at the appropriate rate by reference to the charging bands set out in the said Schedule to this Scheme.

(3) Every Eirpac call made by dial-up access to the public switched telephone exchange system shall be considered to be a local call within the meaning of Article 57 of this Scheme and the appropriate local call telephone charge specified in Part 2 of the First Schedule will be applied thereto, in addition to the Eirpac call charges referred to at paragraph (1) of this Article.

(4) An Eirpac subscriber shall pay in advance to Bord Telecom Éireann in respect of subscription for Eirpac service the appropriate sums set forth in the Fourth Schedule to this Scheme.

(5) An Eirpac subscriber shall pay to Bord Telecom Éireann in respect of connection charges the sums set forth in the Fourth Schedule to this Scheme.

(6) An Eirpac subscriber shall pay to Bord Telecom Éireann in respect of the facilities listed in the Fourth Schedule to this Scheme the sums set forth in the said Schedule.

( b ) The substitution of the following Section VIII of Part 6 for Section VIII of Part 6 of the First Schedule thereto;

Charges in Respect of Integrated Services Digital Network Facility

¹ Basic Access, which consists of 2B+1D channels, is provided with 2 free numbers.

² Primary access, which consists of 30B+1D channels, is provided with 100 free numbers.

Multiple Supplementary Services

Call Charges

1. Standard 3.1kHz voice calls are charged as per Parts 2 to 5 (inclusive), Part 6 Section I (other than subsection 13), Section II and Section VI of this Schedule.

2. Unrestricted 64Kb bearer call charges between exchanges in the State, and between exchanges in the State and exchanges in Northern Ireland.

* Includes calls to the Eirpac Service.

3. Unrestricted 64Kb bearer call charges from exchanges in the State to exchanges in:

( c ) the substitution of the following Fourth Schedule for the Fourth Schedule thereto:

Band 2: Andorra, Austria, Belgium, Denmark (including Faroe Islands), Finland, France, Germany, Great Britain (including Isle of Man and Channel Islands), Greece, Greenland, Iceland, Italy, Luxembourg, Monaco, Netherlands, Norway, Portugal (including Azores and Madeira), San Marino, Spain (including Balearic and Canary Islands), Sweden, Switzerland (including Liechtenstein) and the Vatican City.

Zone 3: Algeria, Armenia, Azerbaijan, Belarus, Bosnia-Herzegovnia, Bulgaria, Croatia, Cyprus, Czech Republic, Estonia, Gibraltar, Georgia, Hungary, Israel, Kazakhstan, Kyrgystan, Latvia, Lebanon, Libya, Lithuania, Malta, Moldova, Morocco, Poland, Romania, Russia, Slovak Republic, Slovenia, Syria, Tajikistan, Tunisia, Turkey, Turkmenistan, Ukraine, Uzbekistan and Yugoslavia (Fed Rep. of).

Band 4: Canada, Mexico and the U.S.A.

Band 5: All other states.

Calls to Global Networks will be charged in accordance with the International Access code used to access the Network.

Band 1: Calls to destinations within the State or in Northern Ireland.

Band 2: Calls to destinations in Great Britain, the Isle of Man,or the Channel Islands.

Band 3: Calls to destinations in Andorra, Austria, Belguim, Denmark, Finland, France, Germany, Greece, Italy, Luxembourg, Monaco, Netherlands, Norway, Portugal, (including Azores and Madeira), Spain (including Balearic & Canary Islands), Sweden, Switzerland (including Liechtenstein), or the Vatican City.

Band 4: Calls to destinations in Algeria, Armenia, Azerbaijan, Bosnia-Herzegovnia, Belarus, Bulgaria, Croatia, Cyprus, Czech Republic, Egypt, Estonia, Georgia, Gibraltar, Hungary, Iceland, Israel, Kazakhstan, Kyrgystan, Latvia, Lebanon, Libya, Lithuania, Malta, Moldova, Morocco, Poland, Romania, Russia, Slovenia, Syria, Tajikistan, Tunisia, Turkmenistan, Ukraine, Uxbekistan and Yugoslavia (Fed. Rep. of).

Band 5: Calls to destinations in Canada or U.S.A. (excluding Alaska and Hawaii).

Band 6: Calls to destinations in other states.

Band 7: Calls via INMARSAT.
