INLAND POST AMENDMENT (NO. 78) SCHEME, 2007.

An Post, in exercise of the powers conferred on it by Section 70 of the Postal and Telecommunications Act 1983 (No. 24 of 1983) as amended by Regulation 8(4) of the European Communities (Postal Services) Regulations 2002 (S.I. No. 616 of 2002), hereby makes the following Scheme:

1.         This Scheme may be cited as the Inland Post Amendment (No. 78) Scheme, 2007.

2.         This Scheme shall be operative with effect from the 1st day of March, 2007.

3.         In this Scheme:-

“the Principal Warrant” means the Inland Post Warrant, 1939 (S.I. No. 202 of 1939) as amended;

“Reserved Services” means the services which are reserved to An Post by Regulation 8 of the European Communities (Postal Services) Regulations S.I. 616 of 2002;

“Scheme No. 36” means the Inland Post Amendment (No. 36) Scheme, 1986 (S.I. No. 362 of 1986), as amended;

“Scheme No. 74” means the Inland Post Amendment (No. 74) Scheme, 2006 (S.I. No. 117 of 2006);

“Scheme No. 76” means the Inland Post Amendment (No. 76) Scheme, 2006, (S.I. No. 132 of 2006);

“Scheme No. 77” means Inland Post Amendment (No. 77) Scheme, 2007, (S.I. No. 93 of 2007).

4.         Words defined in the Principal Warrant shall have the same meaning in this Scheme.

5.         All rates and charges payable upon postal packets in this Scheme pertain to postal packets outside the Reserved Services.

6.         All discounts receivable upon postal packets in this Scheme pertain to postal packets outside the Reserved Services.

7.         The first Schedule to the Principal Warrant is hereby amended by the addition to the entries therein contained (as inserted by Regulation 7 of Scheme No. 77) of the entries in the First Schedule to this Scheme.

8.         Regulation 15 of Scheme No. 74 is hereby repealed.

9.         Regulation 10 of this Scheme applies to postal packets in respect of which agreements are made with An Post in order to achieve cost savings for An Post and the sharing of those cost savings with senders.

10.       There shall be charged and paid upon postal packets posted to which this Scheme applies the rates specified at Item 1 in the First Column of the First Schedule to the Principal Warrant. Subject to the terms of the agreement agreed by the sender and An Post and this Scheme, a sender shall benefit from the discount per postal packet specified in the Second Schedule to this Scheme. Notwithstanding the provisions of Regulation 10 of the Principal Warrant, all postal packets to which this Regulation applies shall bear a prepaid Ceadunas stamp or franking impression approved by An Post.

11.       The Fourth Schedule to the Principal Warrant is hereby amended by the substitution for the entries therein contained of the entries in the Third Schedule to this Scheme.

12.       The First Schedule to Scheme No. 36 is hereby amended by the substitution of the entries therein contained relating to postal packets weighing more than 50g (as inserted by Regulation 7 of Scheme No. 76) of the entries in the Fourth Schedule to this Scheme.

2.   A “Flat” is a postal packet with the following dimensions:

Minimum dimensions:

160mm × 250mm × 0.75mm.

Maximum dimensions:

250 mm × 350 mm × 18mm.

3.   An “An Post Office of Acceptance” means those offices designated for the purposes of this Scheme by An Post, in any location.

4.   An “An Post Mail Centre” means the Dublin Mail Centre, the Portlaoise Mail Centre, the Athlone Mail Centre or the Cork Mail Centre.

5.   “Auto-sort” means sortation by An Post's automated sorting equipment.

6.   “Deferred Processing” means sortation at least one business day after the postal packet enters the public postal network.

5.   An “An Post Office of Acceptance” means those offices designated for the purposes of this Scheme by An Post, in any location.

7.   “Pre-sorted” means items pre-sorted according to the required pre-sort specifications supplied from time to time by An Post.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

This Scheme applies to the Inland Post Service and shall be operative from the 1st day of March, 2007. It changes the rates of postage for items and certain services outside of the reserved area as defined in the European Communities (Postal Services) Regulations 2002 (S.I. No. 616 of 2002). It provides for changes in certain discounts with effect from 1st March, 2007. It authorises increases in the rates of postage and fees charged for Postaim Services above 50 grammes.
