Crisis Pregnancy Agency (Establishment) Order 2001 (Amendment) Order 2007

The Minister for Health and Children in exercise of the powers conferred on her by section 3 of the Health (Corporate Bodies) Act 1961 (No. 27 of 1961) as adapted by the Health (Alteration of Name of Department and Title of Minister) Order 1997 (S.I. No. 308 of 1997) hereby orders as follows:

1.    The Order may be cited as the Crisis Pregnancy Agency (Establishment) Order 2001 (Amendment) Order 2007.

2.    The Crisis Pregnancy Agency (Establishment) Order 2001 (S.I. No. 446 of 2001) shall be amended

(a) in Article 4(i) by substituting for subparagraph (c) the following:

“(c)  the provision of counselling services, medical services and such other health services for the purpose of providing support, after crisis pregnancy, as may be deemed appropriate by the Agency.” and

(b) In Article 4 by substituting for paragraph (vi) the following:

“(vi)  To further the attainment of the objectives specified in Articles 4(i)(a), 4(i)(b) and 4(i)(c), in co-operation with such other persons as may be considered appropriate by the Agency, by

(a)  promoting public awareness

(b)  developing, promoting and disseminating information and informational material, and

(c)  fostering the provision of education and training

to include

(i)  the commissioning of media advertising campaigns

(ii)  the commissioning of electronic media campaigns

(iii)  the development of resource materials, promotional materials and training materials

(iv)  the dissemination of these materials and/or

(v)  such other methods as to the Agency shall seem appropriate for the purpose of performing its functions under paragraph (vi) of this Article.”

(c) in Article 6 by substituting for paragraph (3)

“(3)  Each member of the Agency shall, unless he or she sooner dies, resigns or ceases to be a member of the Agency in accordance with this Article, hold office for such period not exceeding 5 years from the date of his or her appointment, as the Minister may determine.”

(d) In Article 6 by inserting after Article 6 (3):

“3A. A member of the Agency whose term of office expires by the effluxion of time shall be eligible for reappointment to the Agency for such further term or terms of office under Article 6(3) as the Minister may determine.”

(e) in Article 15 by substituting for paragraph (1) the following:

“(1)(a) In order to facilitate the discharge of the functions of the Agency, the Minister may appoint a committee (“the Committee”), consisting of not more than 25 members (including the Chairperson), whose functions shall be to advise the Agency in relation to (i) any matters pertaining to crisis pregnancy as are referred to it by the Agency and (ii) any other matters coming within the remit of the Agency.

(b)  Each member of the Committee shall, unless he or she sooner dies or resigns, hold office for such period not exceeding 5 years from the date of his or her appointment, as the Minister may determine.”

(c)  A member of the Committee whose term of office expires by the effluxion of time shall be eligible for reappointment to the Committee for such further term or terms of office under Article 15(1)(b) as the Minister may determine.”

(f) In Article 25 by inserting after Article 25(2) the following:

“(3)  (a) The Agency shall, not less than once in every period of three years, establish such criteria, terms and conditions in relation to the entering into arrangements and the provision of financial assistance under Article 25(3)(b) as, having regard to its functions, it considers appropriate and shall submit them to the Minister for approval.

      (b)  The Agency may, subject to its available resources, and in accordance with the criteria, terms and/or conditions approved by the Minister under Article 25(3)(a), enter into an arrangement with and provide financial assistance to a person in respect of any service or activity the object of which is to assist the Agency in the attainment the objectives specified in Article 4(i)(a), 4(i)(b) and/or 4(i)(c) hereof.”

The effect of this order is to amend Articles 4, 6, 15 and 25 of the Crisis Pregnancy Agency (Establishment) Order 2001 in relation to the Agency's mandate and functions, the term of office of Board members and membership and term of office of the Advisory Committee.
