I, JOHN GORMLEY, Minister for the Environment, Heritage and Local Government, in exercise of the powers conferred on me by sections 3 , 5 and 14 of the Local Government (Charges) Act 2009 (No. 31 of 2009), hereby make the following Regulations:  | ||
Citation  | ||
1. These Regulations may be cited as the Local Government (Charges) Regulations 2009.  | ||
Commencement  | ||
2. These Regulations come into operation on 24 July 2009.  | ||
Interpretation  | ||
3. In these Regulations—  | ||
“Act” means the Local Government (Charges) Act 2009 ;  | ||
“declaration” means a declaration for the purposes of section 5(1) of the Act;  | ||
“personal public service number” has the meaning assigned to it in section 262 of the of the Social Welfare Consolidation Act 2005 .  | ||
Liability date for 2009  | ||
4. The 31st day of July 2009 is prescribed for the purpose of section 3(1) of the Act as the liability date for the year 2009.  | ||
Payment of charge and making of declaration  | ||
5. A period of two months is prescribed for the purpose of section 3(4) of the Act.  | ||
Making of declaration  | ||
6. (1) A declaration shall be made to the relevant local authority in writing or by means of the internet at www.nppr.ie.  | ||
(2) A declaration shall contain the following information:  | ||
(a) the name (or, in the case of co-owners, names) of the owner of the residential property (“property”) in respect of which the declaration is made;  | ||
(b) the address (and, if necessary, a description) of the property;  | ||
(c) an address for correspondence of the owner or co-owners of the property;  | ||
(d) the personal public service number of the owner, or of each individual co-owner, of the property, where the owner or co-owner concerned is an individual; and  | ||
(e) the tax reference number of the owner, or of each co-owner, of the property, where the owner or co-owner concerned is a company.  | ||
Means of payment  | ||
7. The following means of payment are prescribed for the purposes of section 5(3) of the Act:  | ||
(a) cheque, bank draft, postal order and credit or debit card, where the declaration to which the payment relates is made in writing; or  | ||
(b) credit or debit card, where the declaration to which the payment relates is made by means of the internet.  | ||
