S.I. No. 28/2014 - Hotels Joint Labour Committee Establishment (Amendment) Order 2014.


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 31st January, 2014.

WHEREAS I, RICHARD BRUTON, Minister for Jobs, Enterprise and Innovation, being in receipt of a copy of a recommendation under subsection (5) of section 41A (inserted by section 11 of the Industrial Relations (Amendment) Act 2012 (No. 32 of 2012)) of the Industrial Relations Act 1946 (No. 26 of 1946) and being satisfied that subsection (3) of section 41A has been complied with and considering it appropriate to do so:

NOW, I, RICHARD BRUTON, in exercise of the powers conferred on me by subsection (6) of section 41A (inserted by section 11 of the Industrial Relations (Amendment) Act 2012 (No. 32 of 2012)) of the Industrial Relations Act 1946 (No. 26 of 1946) (as adapted by the Enterprise, Trade and Innovation (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 245 of 2011 )) hereby order as follows:

1. This Order may be cited as the Hotels Joint Labour Committee Establishment (Amendment) Order 2014.

2. The Schedule to the Hotels Joint Labour Committee Establishment Order 1965 ( S.I. No. 81 of 1965 ) is amended—

(a) in paragraph 1, by substituting the following subparagraphs for subparagraphs (e) and (f):

“(e) work performed in leisure facilities including spas and fitness centres and work performed in the provision of health and beautician services;

(f) work performed on outdoor grounds, at any office or at any store or warehouse or similar place.”, and

(b) by substituting the following paragraph for paragraph 2:

“2.In this Schedule “hotel” means—

(a) a premises registered in the register of hotels under the provisions of the Tourist Traffic Acts 1939 to 2011, and

(b) a premises licensed under the Licensing Acts 1833 to 2011 and having not less than 10 apartments normally available for the sleeping accommodation of travellers.”.
