S.I. No. 406/2014 - Housing Assistance Payment (Section 50) Regulations 2014.


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 16th September, 2014.

I, ALAN KELLY, Minister for the Environment, Community and Local Government, in exercise of the powers conferred on me by section 50 of the Housing (Miscellaneous Provisions) Act 2014 (No. 21 of 2014), hereby make the following regulations:

1. These Regulations may be cited as the Housing Assistance Payment (Section 50) Regulations 2014.

2. (1) Part 4 of the Housing (Miscellaneous Provisions) Act 2014 (No. 21 of 2014) shall be applied from 15 September 2014 by each housing authority referred to in paragraph (2) in respect of all classes of qualified household.

(2) The housing authorities for the purposes of paragraph (1) are—

(i) Cork County Council,

(ii) Limerick City and County Council, and

(iii) Waterford City and County Council.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation)

For the purpose of facilitating the introduction of the new housing assistance payment scheme under the Housing (Miscellaneous Provisions) Act 2014 (No. 21 of 2014), these Regulations provide that Part 4 of the Act will, in the first instance, be applied from 15 September 2014 by Cork County Council, Limerick City and County Council and Waterford City and County Council in respect of all classes of qualified household. As section 47 of the 2014 Act is not being brought into operation on 15 September 2014, these authorities will not provide housing assistance in the initial stages of the scheme in respect of households that occupy dwellings provided by approved housing bodies under the capital assistance scheme.

The intention is that further Regulations will be made in due course providing for the application by other housing authorities of Part 4 of the 2014 Act.
