S.I. No. 494/2014 - Artificial Insemination of Greyhounds (Amendment) Regulations 2014.


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 4th November, 2014.

Bord na gCon, in exercise of the powers conferred on it by section 39 (as amended by section 12 of the Horse and Greyhound Racing (Betting Charges and Levies) Act 1999 (No. 24 of 1999)) of the Greyhound Industry Act 1958 (No. 12 of 1958), after consultation with the Irish Coursing Club and with the consent of the Minister for Agriculture, Food and the Marine, hereby makes the following regulations:

1. These regulations may be cited as the Artificial Insemination of Greyhounds (Amendment) Regulations 2014.

2. These regulations shall come into effect on the 1st November, 2014.

3. The Artificial Insemination of Greyhounds Regulations 2005 ( S.I. No. 561 of 2005 ) are amended by:

(a) substituting Regulation 5 (10) for the following:

“(10) Each applicant for an AI licence shall be deemed to have submitted to the jurisdiction of the Club for all regulatory and disciplinary purposes, whether connected with these regulations, or with the Irish Coursing Club Rules. The following condition shall be included in the grant of each AI Licence:

‘The Licence-holder shall be bound by the Rules of the Irish Coursing Club as well as by the Artificial Insemination of Greyhounds Regulations, 2005, for all regulatory and disciplinary purposes connected with this AI Licence and the exercise by the Licence-holder of any function hereunder. Jurisdiction in regard to such regulatory and disciplinary purposes is exercisable by the Irish Coursing Club, either alone or in tandem with Bord na gCon, as the case may be.’ ”;

(b) the deletion of Regulation 11 (h);

(c) substituting Regulation 12 (a) (iv) and 12 (a) (v) for the following:

“(iv) the sire had been DNA tested according to the norms of best practice approved by the Relevant Authority, and giving the information from such testing in the required format.”;

(d) substituting Regulation 14 (3) for the following:

“(3) The Board, having regard to the improvement and development of the greyhound industry in Ireland, and in the light of both national and international developments, and following consultation with the Club, may vary the Period for use of frozen semen of a dead stud sire. Notice of any such variation and the date of its effectiveness shall be published electronically or otherwise.”;

(e) the deletion of Paragraphs (4)-(7) of Regulation 14.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation)

The effect of these regulations is to set down a condition to be included in all AI Licences binding the Licence-holder to the rules of the Irish Coursing Club and to the Artificial Insemination of Greyhounds Regulations, 2005. These regulations also remove the two-year time limit that applies to the use of a deceased stud sire’s semen.
