I, SIMON COVENEY, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 36 of the Animal Health and Welfare Act 2013 (No. 15 of 2013) for the purpose of giving effect to Commission Implementing Decision 2014/689/EU of 29 September 20141 , hereby make the following regulations:

1. These Regulations may be cited as the Foot and Mouth Disease (Non-EU Countries) Regulations 2014.

2. (1) In these Regulations “Commission Decision” means Commission Implementing Decision 2014/689/EU of 29 September 2014.

(2) A word or expression that is used in the Commission Decision and that is also used in these Regulations has, in these Regulations, the same meaning as in the Commission Decision.

3. A person shall not bring a livestock vessel or livestock vehicle into the State from Algeria, Libya, Morocco or Tunisia unless—

(a) it has been cleansed and disinfected in accordance with Article 2 of the Commission Decision,

(b) the cleansing and disinfection is recorded as set out in Article 2 (2) of the Commission Decision, and

(c) a certificate in the form set out in Annex I to the Commission Decision signed by the driver or operator of the livestock vessel or livestock vehicle is presented to an authorised officer at the point of entry into the State.

EXPLANATORY NOTE

These Regulations give effect to Commission Implementing Decision 2014/689/EU of 29 September 2014 to require that vessels or vehicles used to transport livestock into or within certain non-EU Countries are thoroughly cleansed and disinfected prior to entry or re-entry into the Union.
