S.I. No. 196/2015 - European Communities (Classification, Packaging and Labelling) (Revocation) Regulations 2015.


Notice of the making of this Statutory Instrument was published in

I, RICHARD BRUTON, Minister for Jobs, Enterprise and Innovation, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), and for the purpose of giving further effect to Regulation (EC) No. 1272/20081 of the European Parliament and of the Council of 16 December 2008 on classification, labelling and packaging of substances and mixtures, amending and repealing Directives 67/548/EEC2 and 1999/45/EC3 , and amending Regulation (EC) No. 1907/20064 , hereby make the following regulations:

1. (1) These Regulations may be cited as the European Communities (Classification, Packaging and Labelling) (Revocation) Regulations 2015.

(2) These Regulations come into operation on 1 June 2015.

2. In these Regulations, "Regulation (EC) No. 1272/2008" means Regulation (EC) No. 1272/2008 of the European Parliament and of the Council of 16 December 2008 on classification, labelling and packaging of substances and mixtures, amending and repealing Directives 67/548/EEC and 1999/45/EC, and amending Regulation (EC) No. 1907/2006.

3. A word or expression which is used in these Regulations and which is also used in Regulation (EC) No. 1272/2008 has, unless the context otherwise requires, the same meaning in these Regulations as it has in Regulation (EC) No. 1272/2008.

4. Subject to Regulation 5, the following Regulations are revoked:

(a) the European Communities (Aerosol Dispensers and Prepacked Goods) Regulations 1983 ( S.I. No. 166 of 1983 ),

(b) the European Communities (Classification, Packaging and Labelling of Plant Protection Products and Biocide Products) Regulations 2001 ( S.I. No. 624 of 2001 ),

(c) the European Communities (Classification, Packaging, Labelling and Notification of Dangerous Substances) Regulations 2003 ( S.I. No. 116 of 2003 ),

(d) the European Communities (Classification, Packaging and Labelling of Dangerous Preparations) Regulations 2004 ( S.I. No. 62 of 2004 ),

(e) the European Communities (Classification, Packaging, Labelling and Notification of Dangerous Substances) (Amendment) Regulations 2006 ( S.I. No. 25 of 2006 ),

(f) the European Communities (Authorization, Placing on the Market, Use and Control of Biocidal Products) (Amendment) Regulations 2006 ( S.I. No. 393 of 2006 ),

(g) the European Communities (Classification, Packaging and Labelling of Dangerous Preparations) (Amendment) Regulations 2007 ( S.I. No. 76 of 2007 ),

(h) the European Communities (Classification, Packaging and Labelling of Dangerous Preparations) (Amendment) Regulations 2008 ( S.I. No. 271 of 2008 ),

(i) the European Communities (Classification, Packaging, Labelling and Notification of Dangerous Substances) (Amendment) Regulations 2008 ( S.I. No. 272 of 2008 ), and

(j) the European Communities (Classification, Packaging and Labelling of Plant Protection Products and Biocide Products) (Amendment) Regulations 2008 ( S.I. No. 351 of 2008 ).

5. Regulation 4 shall not apply in the case of mixtures classified, labelled and packaged in accordance with the European Communities (Classification, Packaging and Labelling of Dangerous Preparations) Regulations 2003 to 2008 which were placed on the market before 1 June 2015.

6. On and from 1 June 2017 mixtures referred to in Regulation 5 shall be classified, relabelled and repackaged in accordance with Regulation (EC) No. 1272/2008.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation).

Council Directives 67/548/EEC and 1999/45/EC deal with the classification, packaging and labelling of substances and preparations.

The EU “CLP” Regulation (EC) No. 1272/2008 of the European Parliament and of the Council of 16 December 2008 provides (in Article 60) for the repeal of these two Directives with effect from 1 June 2015, and from that date the 2008 EU “CLP” Regulation will become the definitive CLP legislative instrument and a transitioning-out phase of the older EU Directives will come to an end.

Consequently, national Regulations transposing these two Directives are revoked with effect from 1 June 2015 by these Regulations.
