S.I. No. 402/2015 - Animal Health and Welfare (Brucellosis in Cattle) Regulations 2015.

I, SIMON COVENEY, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by Section 36 of the Animal Health and Welfare Act 2013 (No. 15 of 2013), hereby make the following regulations:

1. (1) These Regulations may be cited as the Animal Health and Welfare (Brucellosis in Cattle) Regulations 2015.

(2) These Regulations come into operation on 28 September 2015.

2. The Brucellosis in Cattle (General Provisions) Order, 1991 ( S.I. No. 114 of 1991 ) is amended-

(a) by inserting after Article 9(5) the following-

“(6) Regulation 22 of the Animal Health and Welfare (Bovine Tuberculosis) Regulations 2015 ( S.I. No. 58 of 2015 ) relating to compensation shall apply to this Order and references to Regulation 13(1)(a) and Regulation 13(2)(a) of those Regulations shall be construed as references to a declaration made under Article 7.”, and

(b) by deleting Article 18(2) (as amended by Article 2(h) of the Brucellosis in Cattle (General Provisions) (Amendment) Order 2012 ( S.I. No. 554 of 2012 ).

EXPLANATORY NOTE

These Regulations remove the compulsory Brucellosis pre-movement testing requirement for all eligible male and female animals aged 24 months or more and provide for the payment of compensation in the event of removal of an animal due to Brucellosis infection or suspected Brucellosis infection.
