S.I. No. 302/2018 - Statistics (Environmental Expenditure Survey) Order 2018


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 3rd August, 2018.

I, LEO VARADKAR, Taoiseach, in exercise of the powers conferred on me by section 25 (1) of the Statistics Act 1993 (No. 21 of 1993), and, in relation to Articles 3(b) and 4 (in so far as it relates to Article 3(b)) of, and paragraph 1 of the Schedule to, the following Order, for the purpose of giving full effect to Regulation (EU) No. 691/2011 of the European Parliament and of the Council of 6 July 20111 , as amended by Regulation (EU) No. 538/2014 of the European Parliament and of the Council of 16 April 20142 , in so far as it relates to Annex IV thereto, hereby order as follows:

1. This Order may be cited as the Statistics (Environmental Expenditure Survey) Order 2018.

2. (1) In this Order—

“Regulation” means Regulation (EU) No. 691/2011 of the European Parliament and of the Council of 6 July 20111 as amended by Regulation (EU) No. 538/2014 of the European Parliament and of the Council of 16 April 20142;

“Regulation (EC) 1893/2006” means Regulation (EC) 1893/2006 of the European Parliament and of the Council of 20 December 20063 ;

“survey” means the Environmental Expenditure Survey that is conducted by the Central Statistics Office for the purposes of obtaining information specified in the Schedule—

(a) from persons or undertakings referred to in Article 3(b), including for the purposes of compliance with the Regulation in so far as it relates to Annex IV thereto, and

(b) from persons or undertakings referred to in Articles 3(a) and (c).

(2) A word or expression that is used in this Order and also used in the Regulation has the same meaning in this Order as in the Regulation, other than where the context otherwise requires.

3. Article 4 applies to a person who, or an undertaking that,—

(a) is classified for statistical purposes under section A of NACE Rev. 2 as set out in Annex I to Regulation (EC) 1893/2006 and is registered in the CSO business register,

(b) is classified for statistical purposes under section B, C, D or E of NACE Rev. 2 as set out in Annex I to Regulation (EC) 1893/2006, or

(c) is classified for statistical purposes under any section of NACE Rev. 2 as set out in Annex I to Regulation (EC) 1893/2006 not mentioned in subparagraph (a) or (b).

4. A requirement on persons or undertakings referred to in Article 3 to provide, once only and for the purposes of the survey, information in relation to each year in the period from 2017 to 2021, the general nature of which is specified in the Schedule, is prescribed for the purposes of section 25 of the Statistics Act 1993 (No. 21 of 1993).

SCHEDULE

Article 4

1. Information regarding the following, as it relates to environmental protection expenditure incurred by the person or undertaking concerned during the year to which the information relates:

(a) capital expenditure on the purchase of—

(i) pollution treatment equipment, and

(ii) pollution prevention technology;

(b) operating expenditure on—

(i) the purchase of environmental services,

(ii) environmental protection equipment, and

(iii) environmental protection staff.

2. Information regarding the following, as it relates to resource management expenditure incurred by the person or undertaking concerned during the year to which the information relates:

(a) capital expenditure on the purchase of equipment for the production of resource management products;

(b) operating expenditure on—

(i) the purchase of resource management products,

(ii) resource management equipment, and

(iii) resource management staff.

3. Information on the time taken by the person or undertaking concerned to complete the questionnaire, form or other record prepared by the Director General for the collection of the information referred to in paragraphs 1 and 2.
