S.I. No. 396/2018 - Education (Admission to Schools) Act 2018 (Commencement) Order 2018


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 9th October, 2018.

I, RICHARD BRUTON, Minister for Education and Skills, in exercise of the powers conferred on me by subsections (4) and (5) of section 13 of the Education (Admission to Schools) Act 2018 (No. 14 of 2018) and, in relation to the commencement of section 11 of that Act, after consultation with the Minister for Justice and Equality, hereby order as follows:

1. This Order may be cited as the Education (Admission to Schools) Act 2018 (Commencement) Order 2018.

2. In this Order “Act of 2018” means the Education (Admission to Schools) Act 2018 (No. 14 of 2018).

3. The 3rd day of October 2018 is appointed as the day on which the following provisions of the Act of 2018 shall come into operation:

(a) section 1;

(b) section 9, insofar as it relates to the insertion of the following sections into Part X of the Education Act 1998 (No. 51 of 1998):

(i) section 60;

(ii) section 64;

(iii) section 66;

(c) section 11(a);

(d) section 11(b), other than insofar as it relates to the insertion of the definition of “admission policy” into section 7A(6) of the Equal Status Act 2000 (No. 8 of 2000);

(e) section 13.

4. The 3rd day of December 2018 is appointed as the day on which section 8 of the Act of 2018 shall come into operation.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

This order appoints 3rd October 2018 as the date on which certain provisions of the Education (Admission to Schools) Act 2018 shall come into operation. The provisions concerned are: Section 1 which contains a relevant definition. Section 9 which inserts 3 new sections into the Education Act 1998 - section 60: definitions for this part, section 64: prohibiting schools from charging admission and enrolment fees and section 66: co-operation between boards of management.Section 11 of the Act (other than the definition of ‘admission policy’ for section 7 A of the Equal Status Act 2000 ) which provides for the amendment of section 7 of the Equal Status Act 2000 in relation to its application to recognised primary schools.

This order appoints 3rd December 2018 as the date on which Section 8, of the Education (Admission to Schools) Act 2018 shall come into operation. Section 8 provides for additional provision in respect of children with special educational needs
