S.I. No. 538/2018 - Road Traffic (Amendment) Act 2018 (Commencement) (No. 2) Order 2018


Notice of the making of this Statutory Instrument was published in

I, SHANE ROSS, Minister for Transport, Tourism and Sport, in exercise of the powers conferred on me by section 6 (2) of the Road Traffic (Amendment) Act 2018 (No. 18 of 2018), hereby order as follows:

1. This Order may be cited as the Road Traffic (Amendment) Act 2018 (Commencement) (No. 2) Order 2018.

2. The 22nd day of December 2018 is appointed as the day on which sections 1 , 4 and 5 of the Road Traffic (Amendment) Act 2018 (No.18 of 2018) come into operation.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

This order brings into effect, from 22 December 2018, certain provisions of the Road Traffic (Amendment) Act 2018 . The principal effect of the provisions in question is that they will give the power to the Garda Síochána to detain vehicles driven by learner drivers who drive unaccompanied by a qualified driver. New provisions are also being introduced to make it an offence for the registered owner of the vehicle to allow that vehicle to be driven by an unaccompanied learner or someone who holds neither a driving licence nor a learner permit. In addition there will be some minor technical amendments to the Road Traffic Acts.
