S.I. No. 553/2018 - European Union (Protection of Animals used for Scientific Purposes) (Amendment) Regulations 2018

I, SIMON HARRIS, Minister for Health, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Directive 2010/63/EU of the European Parliament and the Council of 22 September 20101 , hereby make the following regulations:

Citation

1. (1) These Regulations may be cited as the European Union (Protection of Animals used for Scientific Purposes) (Amendment) Regulations 2018.

(2) The Principal Regulations, the European Union (Protection of Animals used for Scientific Purposes) (Amendment) Regulations 2013 ( S.I. No. 434 of 2013 ), the European Union (Protection of Animals used for Scientific Purposes) (Amendment) Regulations 2014 ( S.I. No. 174 of 2014 ), the Regulations of 2016 and these Regulations may be cited together as the European Union (Protection of Animals used for Scientific Purposes) Regulations 2012 to 2018.

Definitions

2. In these Regulations—

“Principal Regulations” means the European Union (Protection of Animals used for Scientific Purposes) Regulations 2012 ( S.I. No. 543 of 2012 );

“Regulations of 2016” means the European Union (Protection of Animals used for Scientific Purposes) (Amendment) Regulations 2016 ( S.I. No. 552 of 2016 ).

Amendment of Regulation 3

3. Regulation 3(1) of the Principal Regulations is amended by inserting after the definition of “IMB” the following definition:

“‘information officer’ means a person designated by a breeder, supplier or user pursuant to Regulation 45A;”.

Amendment of Regulation 36

4. Regulation 36(2) of the Principal Regulations is amended by inserting after subparagraph (e) the following subparagraph:

“(ee) the name and qualifications of the information officer(s),”.

Amendment of Regulation 39

5. Regulation 39(1) of the Principal Regulations is amended by inserting after subparagraph (c) the following subparagraph:

“(cc) the information officer(s),”.

Amendment of Regulation 42

6. Regulation 42(1) of the Principal Regulations is amended by inserting “information officer,” after “animal care and welfare officer,”.

Amendment of Regulation 45

7. The Principal Regulations are amended by substituting for Regulation 45 (as amended by Regulation 5 of the Regulations of 2016) the following regulations:

“Animal care and welfare officer

45. Breeders, suppliers and users shall designate one or more persons on site as animal care and welfare officer, who shall be responsible for overseeing the welfare and care of the animals in the establishment.

Information officer

45A. Breeders, suppliers and users shall designate one or more persons on site as information officer, who shall ensure that staff dealing with animals have access to information specific to the species housed in the establishment.”.

Amendment of Regulation 49

8. Regulation 49(1) of the Principal Regulations is amended by inserting “45A,” after “45,”.

Amendment of Regulation 72

9. Regulation 72(3)(a) of the Principal Regulations is amended—

(a) in clause (iii), by deleting “and”, and

(b) in clause (iv), by inserting “and” after “kept,”.

Amendment of Regulation 82

10. The Principal Regulations are amended by substituting for Regulation 82(2)(c) the following:

“(c) forward, or cause to be forwarded, one of the sealed containers for test, examination or analysis of the sample concerned by a person mentioned in Regulation 83.”.

Amendment of Regulation 84

11. Regulation 84 of the Principal Regulations is amended—

(a) in paragraph (1), by inserting “45A,” after “45,”, and

(b) in paragraph (2)(m), by substituting “Regulations,” for “Regulations.”.

These Regulations amend the European Union (Protection of Animals used for Scientific Purposes) Regulations 2012 to give further effect to Directive 2010/63/EU of the European Parliament and the Council of 22 September 2010 on the protection of animals used for scientific purposes.

These Regulations may be cited as the European Union (Protection of Animals used for Scientific Purposes) (Amendment) Regulations 2018.
