S.I. No. 201/2020 - European Communities (Seed of Oil Plants and Fibre Plants) (Amendment) Regulations 2020

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 9th June, 2020.

I, Michael Creed, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving effect to Commission Implementing Directive (EU) 2020/177 of 11 February 20201 , hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Seed of Oil Plants and Fibre Plants) (Amendment) Regulations 2020.

2. The European Communities (Seed of Oil Plants and Fibre Plants) Regulations 2003 ( S.I. No. 280 of 2003 ) are amended by substituting in Regulation 2(1) for the definition of “EC Directive” (as amended by the European Communities (Seed of Oil Plants and Fibre Plants) (Amendment) Regulations 2016 ( S.I. No. 678 of 2016 )) the following:

“‘Directive’ means Council Directive 2002/57/EC of 13 June 20022 (as amended by Council Directive 2002/68/EC of 19 July 20023 , Commission Directive 2003/45/EC of 28 May 20034 , Council Directive 2003/61/EC of 18 June 20035 , Council Directive 2004/117/EC of 22 December 20046 , Commission Directive 2009/74/EC of 26 June 20097 , Commission Implementing Directive (EU) 2016/11 of 5 January 20168 , Commission Implementing Directive (EU) 2016/317 of 3 March 20169 subject to Commission Regulation (EC) No 217/200610 of 8 February 2006 as it relates to oil and fibre plants and Commission Implementing Directive (EU) 2020/177 of 11 February 2020;”.

EXPLANATORY NOTE

These Regulations give effect to the provisions of Commission Implementing Directive (EU) 2020/177 by amending the Annexes I and II to Directive 2002/57/EC as they relate to inspections for Union regulated non-quarantine pests (RNQPs) and measures intended to prevent their presence on seeds of oil and fibre plants for planting.
