S.I. No. 3/2022 - Disability Act 2005 (Commencement) Order 2022


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 7th January, 2022.

I, STEPHEN DONNELLY, Minister for Health, in exercise of the powers conferred on me by section 1 of the Disability Act 2005 (No. 14 of 2005), having consulted with the Minister for Education (as adapted by the Education and Skills (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 450 of 2020 )), hereby order as follows:

1. This Order may be cited as the Disability Act 2005 (Commencement) Order 2022.

2. The 6th day of January 2022 is fixed as the date on which Part 2 of the Disability Act 2005 (No. 14 of 2005) shall, in so far as it is not already in operation, come into operation in relation to persons born on or after the 1st day of June 2002.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

1. These regulations provide for the extension of Part 2, Disability Act 2005, providing for access to a statutory Assessment of Need to anyone born on or after 1, June 2002.

Part 2 of the Disability Act (2005) provides for independent Assessments of Needs for health and education services occasioned by a disability, and for subsequent Service Statements setting out the services that the individuals concerned will receive, subject to available resources.
