S.I. No. 42/2022 - Health Act 1947 (Section 31A - Temporary Restrictions) (Covid-19) (Restrictions upon Travel to the State from Certain States) (No. 5) (Amendment) (No. 2) Regulations 2022


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 4th February, 2022.

The Minister for Health, in exercise of the powers conferred on him by sections 5 and 31A (inserted by section 10 of the Health (Preservation and Protection and other Emergency Measures in the Public Interest) Act 2020 (No. 1 of 2020)) of the Health Act 1947 (No. 28 of 1947) and -

(a) having regard to the immediate, exceptional and manifest risk posed to human life and public health by the spread of Covid-19 and to the matters specified in subsection (2) of section 31A, and

(b) having consulted with the Minister for Transport, the Minister for Foreign Affairs, the Minister for Housing, Local Government and Heritage, the Minister for Justice, the Minister for Enterprise, Trade and Employment and the Minister for Tourism, Culture, Arts, Gaeltacht, Sport and Media,

hereby makes the following regulations:

1. These Regulations may be cited as the Health Act 1947 (Section 31A - Temporary Restrictions) (Covid-19) (Restrictions upon Travel to the State from Certain States) (No. 5) (Amendment) (No. 2) Regulations 2022.

2. In these Regulations, “Principal Regulations” means the Health Act 1947 (Section 31A - Temporary Restrictions) (Covid-19) (Restrictions upon Travel to the State from Certain States) (No. 5) Regulations 2021 ( S.I. No. 135 of 2021 ).

3. These Regulations shall come into operation on the 1st day of February 2022.

4. Regulation 1(3) of the Principal Regulations is amended by the substitution of “31st day of March 2022” for “9th day of February 2022”.

5. Regulation 2 of the Principal Regulations is amended by the substitution of the following definition for the definition of “vaccinated person”:

“ ‘vaccinated person’ means –

(a) a person, other than a person referred to in paragraph (b), to whom –

(i) the medicinal product for active immunisation to prevent Covid-19 known as “Spikevax (previously COVID-19 Vaccine Moderna) CX024414” has been administered such that the second dose of the medicinal product concerned has been administered to the person not less than 14 days and not more than 270 days before his or her arrival in the State,

(ii) the medicinal product for active immunisation to prevent Covid-19 known as “Vaxzevria (previously COVID-19 Vaccine AstraZeneca) ChAdOx1-SARS-COV-2”, also known as “Covishield”, has been administered such that the second dose of the medicinal product concerned has been administered to the person not less than 14 days and not more than 270 days before his or her arrival in the State,

(iii) the medicinal product authorised for active immunisation to prevent Covid-19 known as “Comirnaty BNT162b2” has been administered such that the second dose of the medicinal product concerned has been administered to the person not less than 14 days and not more than 270 days before his or her arrival in the State,

(iv) one dose of the medicinal product authorised for active immunisation to prevent Covid-19 known as “COVID-19 Vaccine Janssen (Ad26.COV2-S [recombinant])” has been administered not less than 14 days and not more than 270 days before his or her arrival in the State,

(v) the medicinal product for active immunisation to prevent Covid-19 known as “COVID-19 Vaccine (Vero Cell) Inactivated”, also known as “CoronaVac”, has been administered such that the second dose of the medicinal product concerned has been administered to the person not less than 14 days and not more than 270 days before his or her arrival in the State,

(vi) the medicinal product for active immunisation to prevent Covid-19 known as “Inactivated COVID-19 (VERO CELL) vaccine”, also known as “SinoPharm / BIBP”, has been administered such that the second dose of the medicinal product concerned has been administered to the person not less than 14 days and not more than 270 days before his or her arrival in the State,

(vii) the medicinal product for active immunisation to prevent Covid-19 known as “Bharat Biotech BBV152”, also known as “COVAXIN”, has been administered such that the second dose of the medicinal product concerned has been administered to the person not less than 14 days and not more than 270 days before his or her arrival in the State,

(viii) the medicinal product for active immunisation to prevent Covid-19 known as “Nuvaxovid (NVX-CoV2373)”, also known as “Novavax”, has been administered such that the second dose of the medicinal product concerned has been administered to the person not less than 14 days and not more than 270 days before his or her arrival in the State,

(ix) any combination of the medicinal products referred to in subparagraphs (i), (ii), (iii), (v), (vi), (vii) and (viii) has been administered such that the second dose of the relevant combination has been administered to the person not less than 14 days and not more than 270 days before his or her arrival in the State, or

(x) one dose of a medicinal product referred to in subparagraph (i), (ii), (iii), (v), (vi), (vii) or (viii) has been administered not more than 180 days after the person was subject to a RT-PCR test the result of which confirmed that Covid-19, or the virus SARS-CoV-2, was detected in the person at the time of taking the test and which product has been administered not less than 14 days and not more than 270 days before his or her arrival in the State, or

(b) a person to whom –

(i) the relevant dose or doses, as the case may be, specified in any of subparagraphs (i) to (x) of paragraph (a) has or have been administered, whether within 270 days before his or her arrival in the State or otherwise, and

(ii) an additional dose or a booster or subsequent dose of a medicinal product referred to in subparagraphs (i) to (viii) of paragraph (a) has been administered before his or her arrival in the State.”.

These Regulations amend the Health Act 1947 (Section 31A - Temporary Restrictions) (Covid-19) (Restrictions upon Travel to the State from States) (No. 5) Regulations 2021 ( S.I. No. 135 of 2021 ) to provide for the acceptance of an additional vaccine product for travel purposes, to limit the standard acceptance period of proofs of vaccination in respect of primary vaccine courses to 270 days and to provide for acceptance of vaccination certificates issued for booster doses.
