S.I. No. 167/2022 - Residential Tenancies (Amendment) Act 2019 (Commencement) Order 2022


Notice of the making of this Statutory Instrument was published in

I, DARRAGH O’BRIEN, Minister for Housing, Local Government and Heritage, in exercise of the powers conferred on me by subsection (4) of section 1 of the Residential Tenancies (Amendment) Act 2019 (No. 14 of 2019) (as adapted by the Housing, Planning and Local Government (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 408 of 2020 )), hereby order as follows:

1. This Order may be cited as the Residential Tenancies (Amendment) Act 2019 (Commencement) Order 2022.

2. The 4th day of April 2022 is appointed to be the day on which the Residential Tenancies (Amendment) Act 2019 (No. 14 of 2019) shall, insofar as it is not already in operation, come into operation.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

This Order appoints 4 April 2022 as the date on which the remaining provisions of the Residential Tenancies (Amendment) Act 2019 come into effect.

Specifically, section 26 and insofar as they are not already in operation, sections 22, 23, 24, 25 and 29 come into effect on 4 April 2022 on foot of this Order.

The aforementioned provisions require the annual registration of tenancies with the Residential Tenancies Board (RTB) and provide for associated registration fees and minor technical amendments to the Residential Tenancies Act 2004 . Section 29(b) of the Residential Tenancies (Amendment) Act 2019 is also commenced requiring the Minister for Housing, Local Government and Heritage to report to the Houses of the Oireachtas on prevailing rent levels, informed by data collected via the RTB’s new annual tenancy registration system.

The other provisions of the Residential Tenancies (Amendment) Act 2019 were previously commenced under the following Statutory Instruments:

Residential Tenancies (Amendment) Act 2019 (Commencement) Order 2019 ( S.I. No. 236 of 2019 );

Residential Tenancies (Amendment) Act 2019 (Commencement)(No. 2) Order 2019 ( S.I. No. 286 of 2019 ); and

Residential Tenancies (Amendment) Act 2019 (Commencement)(No. 3) Order 2019 ( S.I. No. 354 of 2019 ).

Sections 25 and 26 of Local Government Rates and Other Matters Act 2019 (No. 24 of 2019) amend the Residential Tenancies Act 2004 and the Residential Tenancies (Amendment) Act 2019 respectively, and the following Statutory Instruments refer:

Local Government Rates and Other Matters Act 2019 (Commencement) Order 2019 ( S.I. No. 355 of 2019 ; and

Local Government Rates and Other Matters Act 2019 (Commencement) Order 2022 ( S.I. No. 164 of 2022 ).
