S.I. No. 333/2022 - Parent’s Leave and Benefit Act 2019 (Extension of Periods of Leave) Order 2022

I, RODERIC O’GORMAN, Minister for Children, Equality, Disability, Integration and Youth, in exercise of the powers conferred on me by subsection (7) of section 5 of the Parent’s Leave and Benefit Act 2019 (No. 35 of 2019) and the Disability, Equality, Human Rights, Integration and Reception (Transfer of Departmental Administration and Ministerial Functions) Order 2020 (S.I. No. 436 of 2020) (as adapted by the Children and Youth Affairs (Alteration of Name of Department and Title of Minister) Order 2020 (S.I. No. 437 of 2020)), with the consent of the Minister for Social Protection (as adapted by the Employment Affairs and Social Protection (Alteration of Name of Department and Title of Minister) Order 2020 (S.I. No. 447 of 2020)) and the Minister for Public Expenditure and Reform, and having had regard to the likely effect of the following order on the matters specified in paragraphs (a) to (e) of subsection (9) of that section, hereby make the following order with respect to which, pursuant to subsection (10) of that section, a draft has been laid before each House of the Oireachtas and a resolution approving the draft has been passed by each such House:

1. (1) This Order may be cited as the Parent’s Leave and Benefit Act 2019 (Extension of Periods of Leave) Order 2022.

(2) This Order shall come into operation on 1 July 2022.

2. In this Order –

“Act of 2021” means the Family Leave and Miscellaneous Provisions Act 2021 (No. 4 of 2021);

“Principal Act” means the Parent’s Leave and Benefit Act 2019 (No. 35 of 2019).

3. Section 5(1) (amended by section 26 of the Act of 2021) of the Principal Act is amended by the substitution of “7 weeks” for “5 weeks”.

4. Section 16(1) (amended by section 29 of the Act of 2021) of the Principal Act is amended by the substitution of “7 weeks” for “5 weeks”.

The Minister for Social Protection consents to the foregoing Order.
