I, PETER BURKE, Minister for Enterprise, Tourism and Employment, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Regulation (EU) 2024/1689 of the European Parliament and of the Council of 13 June 2024 laying down harmonised rules on artificial intelligence and amending Regulations (EC) No 300/2008, (EU) No 167/2013, (EU) No 168/2013, (EU) 2018/858, (EU) 2018/1139 and (EU) 2019/2144 and Directives 2014/90/EU, (EU) 2016/797 and (EU) 2020/1828 (Artificial Intelligence Act), hereby make the following regulations:

Citation

1. These Regulations may be cited as the European Union (Artificial Intelligence) (Designation) Regulations 2025.

Interpretation

2. (1) In these Regulations –

“Artificial Intelligence Regulation” means Regulation (EU) 2024/1689 of the European Parliament and of the Council of 13 June 20241 laying down harmonised rules on artificial intelligence and amending Regulations (EC) No 300/2008, (EU) No 167/2013, (EU) No 168/2013, (EU) 2018/858, (EU) 2018/1139 and (EU) 2019/2144 and Directives 2014/90/EU, (EU) 2016/797 and (EU) 2020/1828 (Artificial Intelligence Act);

“Marine Survey Office” means that part of the Department of Transport which is known by that name;

“Minister” means the Minister for Enterprise, Tourism and Employment.

(2) A word or expression that is used in these Regulations and also used in the Artificial Intelligence Regulation has, unless the context otherwise requires, the same meaning in these Regulations as it has in that Regulation.

(3) In these Regulations –

(a) a reference to a numbered Article is a reference to the Article so numbered of the Artificial Intelligence Regulation, and

(b) a reference to a numbered Annex is a reference to the Annex so numbered of the Artificial Intelligence Regulation.

Designation of national competent authorities

3. For the purposes of Article 70(1) –

(a) the Minister is designated as a national competent authority, and

(b) each of the following market surveillance authorities specified in the third column of the Schedule is designated as the national competent authority for the purpose of the point of Section A, Annex I specified in the second column of the Schedule opposite mention of the market surveillance authority concerned.

Designation of market surveillance authorities

4. (1) The Central Bank of Ireland is designated as the market surveillance authority for the purposes of Article 74(6).

(2) The Data Protection Commission is designated as the market surveillance authority for the purposes of Article 74(8).

Designation of notifying authorities

5. For the purposes of Article 28, the following bodies are designated as notifying authorities:

(a) in respect of Union harmonisation legislation listed in points 1, 2, 4, 5, 7, 9 and 10 of Section A, Annex I, the Minister;

(b) in respect of Union harmonisation legislation listed in points 3 and 8 of Section A, Annex I, the Minister for Transport;

(c) in respect of Union harmonisation legislation listed in points 11 and 12 of Section A, Annex I, the Health Products Regulatory Authority;

(d) in respect of Union harmonisation legislation listed in point 6 of Section A, Annex I, the Commission for Communications Regulation.

Designation of single point of contact

6. The Minister is designated as the single point of contact for the purposes of Article 70(2).
