S.I. No. 394/2025 - European Union (International Labour Organisation Work in Fishing Convention) (Safe Manning) (Amendment) Regulations 2025

I, DARRAGH O’BRIEN, Minister for Transport, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), and for the purpose of giving further effect to Article 10 of the Annex to Council Directive (EU) 2017/159 of 19 December 20161 , and to Article 3 of that Directive, hereby make the following regulations:

1. These Regulations may be cited as the European Union (International Labour Organisation Work in Fishing Convention) (Safe Manning) (Amendment) Regulations 2025.

2. Regulation 5 of the European Union (International Labour Organisation Work in Fishing Convention) (Safe Manning) Regulations 2024 ( S.I. No. 52 of 2024 ) is amended by substituting for paragraph (13) the following:

“(13) Notwithstanding the revocation of the Fishing Vessels (Certification of Deck Officers and Engineer Officers) Regulations 1988 ( S.I. No. 289 of 1988 ), the Merchant Shipping (Safe Manning, Hours of Work and Watchkeeping) Regulations 1998 ( S.I. No. 551 of 1998 ) and the European Union (International Labour Organisation Work in Fishing Convention) (Safe Manning) Regulations 2023 ( S.I. No. 315 of 2023 ), any minimum safe manning document issued to a fishing vessel pursuant to any of those Regulations shall continue in force.”.

EXPLANATORY NOTE

These Regulations confirm that, notwithstanding the revocation of the European Union (International Labour Organisation Work in Fishing Convention) (Safe Manning) Regulations 2023 ( S.I. No. 315 of 2023 ), any safe manning document issued under those regulations continues in force.
