S.I. No. 427/2025 - European Union (Waste Electrical and Electronic Equipment) (Amendment) Regulations 2025

I, DARRAGH O’BRIEN, Minister for Climate, Energy and the Environment, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), and for the purpose of giving effect to Directive (EU) 2024/884 of the European Parliament and of the Council of 13 March 20241 amending Directive 2012/19/EU of the European Parliament and of the Council of the 4 July 20122 on waste electrical and electronic equipment, hereby make the following regulations:

Citation

1. These Regulations may be cited as the European Union (Waste Electrical and Electronic Equipment) (Amendment) Regulations 2025.

Interpretation

2. (1) In these Regulations –

“Principal Regulations” means the European Union (Waste Electrical and Electronic Equipment) Regulations 2014 ( S.I. No. 149 of 2014 ).

Amendment of Regulation 3 of the Principal Regulations

3. Regulation 3 of the Principal Regulations is amended by inserting the following definition after the definition of “non-road mobile machinery”:

“open scope EEE” means, EEE referred to in Regulation 4(1)(b), which does not fall within the scope of Regulation 4(1)(a), subject to Regulation 4(2) and (3);”

Amendment of Regulation 16 of the Principal Regulations

4. Regulation 16 of the Principal Regulations is amended-

(a) by substituting for paragraph (1) the following:

“(1) Each producer placing electrical and electronic equipment on the market in the State shall ensure that he or she or a third party acting on his or her behalf finances the environmentally sound management of waste electrical and electronic equipment from private households deposited at collection points in the functional areas of all local authorities relating to-

(a) waste arising from his or her own products of electrical and electronic equipment categorised in Schedule 1, other than photovoltaic panels, where such electrical and electronic equipment was placed on the market after 13 August 2005,

(b) waste arising from photovoltaic panels placed on the market by him or her from 13 August 2012,

(c) waste arising from his or her own products of open scope EEE placed on the market from 15 August 2018, and

(d) all products of electrical and electronic equipment for private households placed on the market in the State prior to 13 August 2005, with the exception of photovoltaic panels, in proportion to his or her current share of the market by type of equipment as categorised in Schedule 1, as determined by the registration body or, as appropriate, a third party acting on its behalf when the respective costs occur.”.

(b) by substituting for paragraph (2) the following:

“(2) When a product is placed on the market in the State as referred to in paragraph (1) subparagraphs (a) – (c), the producer shall provide, within the twentieth working day of the month following its placement on the market in the State, a financial guarantee showing that the full cost of the environmentally sound management of waste electrical and electronic equipment will be financed when it is discarded by the final user.”.

Amendment of Regulation 18 of the Principal Regulations

5. Regulation 18 of the Principal Regulations is amended -

(a) by substituting for paragraph (1) the following:

“(1) Each producer placing electrical and electronic equipment on the market in the State shall ensure that he or she or a third party acting on his or her behalf finances the environmentally sound management of waste electrical and electronic equipment arising from users other than private households as follows -

(a) for waste electrical and electronic equipment arising from electrical and electronic equipment categorised in Schedule 1, other than photovoltaic panels, where such electrical and electronic equipment was placed on the market in the State after 13 August 2005,

(b) for waste electrical and electronic equipment arising from photovoltaic panels where such photovoltaic panels were placed on the market in the State from 13 August 2012,

(c) for waste electrical and electronic equipment arising from open scope EEE placed on the market in the State from 15 August 2018, and

(d) for waste arising from electrical and electronic equipment categorised in Schedule 1, excluding photovoltaic panels, placed on the market in the State prior to 13 August 2005 being replaced by new equivalent products or by new products fulfilling the same function.”.

(b) by substituting for paragraph (2) the following:

“(2) Where waste arising from electrical and electronic equipment for users other than private households categorised in Schedule 1, excluding photovoltaic panels, which was placed on the market in the State prior to 13 August 2005 is not being replaced with products of the equivalent type or new products fulfilling the same function, the final user of that waste shall be responsible for –

(a) its delivery to an authorised facility carrying out the treatment of waste electrical and electronic equipment,

(b) recording the quantity delivered and treated at an authorised facility, and

(c) financing its treatment, recovery and environmentally sound disposal.”.

(c) by substituting for paragraph (3) the following:

“(3) Without prejudice to sub-regulation (1), a distributor to users other than private households, shall supply each purchaser with details of the producer responsible for financing the environmentally sound management of –

(a) each item of electrical and electronic equipment as categorised in Schedule 1, other than photovoltaic panels, placed on the market in the State on and from 13 August 2005 when it reaches end of life,

(b) photovoltaic panels where such photovoltaic panels were placed on the market in the State from 13 August 2012,

(c) each item of open scope EEE placed on the market in the State from 15 August 2018, and

(d) waste electrical and electronic equipment arising from electrical and electronic equipment categorised in Schedule 1, excluding photovoltaic panels, placed on the market in the State prior to 13 August 2005 that is now being replaced by him or her with new equivalent products or with new products fulfilling the same function.”.

Amendment of Regulation 20 of the Principal Regulations

6. Regulation 20 of the Principal Regulations is amended by substituting for paragraph (3) the following:

“(3) Each producer or authorised representative shall ensure that he or she or a third party acting on his or her behalf shall make adequate arrangements to provide for the collection-

(a) of waste electrical and electronic equipment arising from private households, excluding photovoltaic panels, that was placed on the market in the State prior to 13 August 2005 in proportion to his or her current respective share of the market in the State by type of equipment as categorised in Schedule 1, or,

(b) all waste electrical and electronic equipment from private households arising from,

(i) his or her own products of electrical and electronic equipment categorised in Schedule 1, other than photovoltaic panels, where such electrical and electronic equipment was placed on the market in the State after 13 August 2005,

(ii) photovoltaic panels placed on the market in the State by him or her from 13 August 2012, and

(iii) his or her own products of open scope EEE placed on the market in the State from 15 August 2018,

from collection points situated in the functional area of each local authority.”.

Amendment to the Regulation 28 of the Principal Regulations

7. Regulation 28 of the Principal Regulations is amended by inserting after paragraph (1) the following paragraphs:

“(1A) For photovoltaic panels, the obligation referred to in paragraph (1) shall only apply to photovoltaic panels placed on the market from 13 August 2012.

(1B) For open scope EEE the obligation referred to in paragraph (1) shall only apply to EEE placed on the market from 15 August 2018.”.

Amendment to Schedule 13 of the Principal Regulations

8. Schedule 13 of the Principal Regulations is amended by substituting “European Standard EN 50419:2022” for “European Standard EN50419”.

These Regulations amend the European Union (Waste Electrical and Electronic Equipment) Regulations 2014 ( S.I. No. 149 of 2014 ) in order to give effect to the provisions of Directive (EU) 2024/884 of the European Parliament and of the Council of 13 March 2024 amending Directive 2012/19/EU on waste electrical and electronic equipment (WEEE).
