S.I. No. 611/2025 - Planning and Development Act 2024 (Modification) Regulations 2025

I, JAMES BROWNE, Minister for Housing, Local Government and Heritage, in exercise of the powers conferred on me by section 4 (6) of the Planning and Development Act 2024 (No. 34 of 2024), being of the opinion that the following regulations are necessary or expedient for the purposes set out in that subsection for bringing subsection (2) of section 69 and subsection (8) of section 81 of that Act into operation, hereby make the following regulations with respect to which, pursuant to section 4 (4) of that Act, a draft has been laid before each House of the Oireachtas and a resolution approving the draft has been passed by each such House:

Citation

1. These Regulations may be cited as the Planning and Development Act 2024 (Modification) Regulations 2025.

Definitions

2. In these Regulations—

“Act of 2025” means Planning and Development (Amendment) Act 2025 (No. 9 of 2025);

“Principal Act” means Planning and Development Act 2024 (No. 34 of 2024).

Modification to section 69 of Principal Act

3. Section 69 (inserted by section 14 of the Act of 2025) of the Principal Act is modified in subsection (2) whereby the reference to “before the commencement of the repeal of Part II of that Act by section 6” shall be read as “before the repeal of that section by section 6”.

Modification to section 81 of Principal Act

4. Section 81 of the Principal Act is modified in subsection (8) (inserted by section 15(f) of the Act of 2025) whereby the reference to “before the commencement of the repeal of Part II of that Act” shall be read as “before the repeal of that section by section 6”.

These Regulations modify subsection (2) of section 69 and subsection (8) of section 81 of Planning and Development Act 2024 for the purpose of those provisions’ operation.
