I, PETER BURKE, Minister for Enterprise, Tourism and Employment, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Regulation (EU) 2024/3015 of the European Parliament and of the Council of 27 November 20241 on prohibiting products made with forced labour on the Union market and amending Directive (EU) 2019/1937, hereby make the following regulations: | ||
1. These Regulations may be cited as the European Union (Prohibiting products made with forced labour on the Union market) (Designation of Competent Authorities) Regulations 2025. | ||
2. (1) In these Regulations – | ||
“Forced Labour Regulation” means Regulation (EU) 2024/3015 of the European Parliament and of the Council of 27 November 20241 on prohibiting products made with forced labour on the Union market and amending Directive (EU) 2019/1937; | ||
“Market Surveillance Regulation” means Regulation (EU) 2019/1020 of the European Parliament and of the Council of 20 June 20192 ; | ||
“relevant market surveillance authority” means – | ||
(a) an authority designated as a market surveillance authority in the State in accordance with the European Union (General Product Safety) Regulations 2024 ( S.I. No. 726 of 2024 ) for the purposes of the General Product Safety Regulation, or | ||
(b) an authority designated as a market surveillance authority in the State in accordance with the Market Surveillance Regulation in respect of a European Union instrument listed in Annex I to the Market Surveillance Regulation, | ||
in relation to a product, insofar as the Forced Labour Regulation applies to that product. | ||
(2) A word or expression that is used in these Regulations and also used in the Forced Labour Regulation has, unless the context otherwise requires, the same meaning in these Regulations as it has in the Forced Labour Regulation. | ||
(3) In these Regulations, a reference to a numbered Article is a reference to the Article so numbered of the Forced Labour Regulation. | ||
3. The Workplace Relations Commission is designated as the competent authority for the purposes of Articles 9, 10, 14, 16, 17, 18, 19, 20, 21, 22, 26(3) and (5), 28, 29 and 30. | ||
4. The relevant market surveillance authority is designated as the competent authority for the purposes of Articles 23, 24, and 25. | ||
