I, JAMES BROWNE, Minister for Housing, Local Government and Heritage, in exercise of the powers conferred on me by section 133(1) of the Withdrawal of the United Kingdom from the European Union (Consequential Provisions) Act 2020 (No. 23 of 2020), hereby make the following regulations:

PRELIMINARY AND GENERAL

Citation and commencement
|
| |
1. (1) These Regulations may be cited as the Withdrawal of the United Kingdom from the European Union (Consequential Provisions) Act 2020 (Construction Products – Market Surveillance) (Amendment) Regulations 2025.
|
| |
(2) These Regulations shall come into operation on the 8th day of January 2026.
|

Definition
|
| |
2. In these Regulations, “Regulations of 2020” means the Withdrawal of the United Kingdom from the European Union (Consequential Provisions) Act 2020 (Construction Products – Market Surveillance) Regulations 2020 (S.I. No. 682 of 2020).

AMENDMENT OF REGULATIONS OF 2020

Amendment of Regulations of 2020

3. The Regulations of 2020 are amended by the insertion of the following Regulation after Regulation 1:
|

“Definitions
|
| |
1A. In these Regulations—
|
| |
‘Construction Products Regulation 2011’ means Regulation (EU) No 305/2011 of the European Parliament and of the Council of 9 March 20111
laying down harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC;
|
| |
‘Construction Products Regulation 2024’ means Regulation (EU) 2024/3011 of the European Parliament and of the Council of 27 November 20242
laying down harmonised rules for the marketing of construction products and repealing Regulation (EU) No 305/2011.”.
|

Amendment of Regulation 2 of Regulations of 2020
|
| |
4. Regulation 2 of the Regulations of 2020 is amended by the substitution of “European Union (Construction Products) Regulations 2025” for “European Union (Construction Products) Regulations 2013 (S.I. No. 225 of 2013)”.

Amendment of Regulation 3 of Regulations of 2020
|
| |
5. Regulation 3 of the Regulations of 2020 is amended by the substitution of “Construction Products Regulation 2011 and the Construction Products Regulation 2024” for “Construction Products Regulation”.
