The Maritime Area Regulatory Authority, in exercise of the powers conferred on it by section 90 (1) of the Maritime Area Planning Act 2021 , after consultation with the Minister of State at the Department of Climate, Energy and the Environment (as adapted by the Climate, Energy and the Environment (Delegation of Ministerial Functions) (No. 2) Order 2025 ( S.I. 384 of 2025 )) and having had regard to the matters listed in section 90(2) of the Act, hereby orders as follows: | ||
Citation | ||
1. This Order may be cited as the Maritime Area Planning Act 2021 (Fit and Proper Person – Uisce Éireann) Order 2026. | ||
Interpretation | ||
2. In this Order: | ||
“Act” means Maritime Area Planning Act 2021 (No. 50 of 2021); and | ||
“MAC” means maritime area consent. | ||
Specified fit and proper person | ||
3. That Uisce Éireann designated activity company, registered in the companies registration office with registered number 530363 and having its registered office at Colvill House, 24/26 Talbot Street, Dublin 1 is, for the purpose of Section 90(1)(a)(i) of the Act, hereby declared a fit and proper person to be granted and to hold any MAC. | ||

This Order provides for Uisce Éireann dac to be declared a fit and proper person to be granted a Maritime Area Consent (MAC), both at the time a MAC application is made and at the time that the MAC application concerned is determined by the Maritime Area Regulatory Authority (MARA). |
