I, JENNIFER CARROLL MACNEILL, Minister for Health, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving full effect to Commission Implementing Regulation (EU) 2026/459 of 24 February 20261 , hereby make the following regulations: | ||
Citation | ||
1. These Regulations may be cited as the European Union (Official Controls in relation to Food Legislation) (Imports of Food of Non-Animal Origin) (Amendment) (No. 2) Regulations 2026. | ||
Definition | ||
2. In these Regulations, “Principal Regulations” means the European Union (Official Controls in relation to Food Legislation) (Imports of Food of Non-Animal Origin) Regulations 2020 ( S.I. No. 575 of 2020 ). | ||
Amendment of Regulation 2(1) of Principal Regulations | ||
3. Regulation 2(1) (amended by Regulation 3 of the European Union (Official Controls in relation to Food Legislation) (Imports of Food of Non-Animal Origin) (Amendment) Regulations 2026 ( S.I. No. 47 of 2026 )) of the Principal Regulations is amended— | ||
(a) by the substitution of the following definition for the definition of “Annex II to EU Regulation 2019/1793”: | ||
“ ‘Annex II to EU Regulation 2019/1793’ means Annex II to EU Regulation 2019/1793 of 22 October 20192 as amended by Article 1 of Commission Implementing Regulation (EU) 2026/194 of 28 January 20263 and Article 1(3) of Commission Implementing Regulation (EU) 2026/459 of 24 February 20261 ;”, and | ||
(b) by the substitution of the following definition for the definition of “EU Regulation 2019/1793”: | ||
“ ‘EU Regulation 2019/1793’ means Commission Implementing Regulation (EU) 2019/1793 of 22 October 20192 as amended by Commission Implementing Regulation (EU) 2020/625 of 6 May 20204 , Commission Implementing Regulation (EU) 2021/608 of 14 April 20215 , Commission Implementing Regulation (EU) 2021/1900 of 27 October 20216 , Commission Implementing Regulation (EU) 2022/913 of 30 May 20227 , Commission Implementing Regulation (EU) 2024/286 of 16 January 20248 , Commission Implementing Regulation (EU) 2024/3153 of 18 December 20249 , Commission Implementing Regulation (EU) 2025/1441 of 18 July 202510 , Commission Implementing Regulation (EU) 2026/194 of 28 January 20263 and Commission Implementing Regulation (EU) 2026/459 of 24 February 20261 ;”. | ||
Insertion of Regulation 23A into Principal Regulations | ||
4. The Principal Regulations are amended by inserting the following Regulation after Regulation 23: | ||
“Transitional provision: arachidonic acid oil | ||
23A. Notwithstanding Regulation 20(4), until (and including) 26 April 2026 an operator shall not be guilty of an offence where he or she imports into the State from a third country, without complying with the requirement in Regulation 8(1)(m)(ii)(II) or (IV), a consignment of arachidonic acid oil from China, dispatched before 26 February 2026 from the country of origin, or from another third country if that third country is different from the country of origin.”. | ||

EXPLANATORY NOTE | ||

These Regulations give full effect to Commission Implementing Regulation (EU) 2026/459 of 24 February 2026 amending Implementing Regulation (EU) 2019/1793 as regards the temporary increase of official controls and emergency measures governing the entry into the Union of arachidonic acid oil originating in China. | ||
These Regulations amend the European Union (Official Controls in relation to Food Legislation) (Imports of Food of Non-Animal Origin) Regulations 2020 ( S.I. No. 575 of 2020 ) in the manner specified in these Regulations. | ||
