S.I. No. 293/2026 - International Protection Act 2026 (Section 155) (Personal Interview Report) Regulations 2026


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 26th June, 2026.

I, JIM O’CALLAGHAN, Minister for Justice, Home Affairs and Migration, in exercise of the powers conferred on me by sections 3 and 155(1) of the International Protection Act 2026 (No. 9 of 2026), hereby make the following regulations:

1. These Regulations may be cited as the International Protection Act 2026 (Section 155) (Personal Interview Report) Regulations 2026.

2. In these Regulations, “Act of 2026” means the International Protection Act 2026 (No. 9 of 2026).

3. The Determining Authority or any other authority or experts assisting the Determining Authority with conducting personal interviews in accordance with section 152(7) of the Act of 2026 shall produce a thorough and factual report containing all the main elements of the personal interview.

4. The personal interview report referred to in Regulation 3 shall—

(a) in the case of a substantive interview, contain the information specified in Schedule 1,

(b) in the case of an admissibility interview, contain the information specified in Schedule 2, and

(c) be in electronic form.

5. Nothing in these Regulations shall prevent a written copy of an interview report being provided to an applicant where necessary to ensure that he or she can have access to the report.

6. Nothing in these Regulations shall prevent information additional to that specified in Schedule 1 or 2 from being requested from an applicant during a personal interview and included in the personal interview report.

Regulation 4(a)

1. Details of applicant’s identity, including:

i. First name(s) and last name(s)

ii. Country of origin

iii. Nationality/Nationalities

iv. Marital status

v. Family members

vi. Religion

vii. Ethnicity

2. Details of contact and address information, including:

i. Email address

ii. Address in the State

iii. Address(es) elsewhere, including in country of origin

3. Details of travel to the State, including:

i. Date when applicant left country of origin

ii. Date when applicant arrived in the State

iii. Countries the applicant travelled through before arriving in the State

4. Details related to international protection application, including:

i. Previous international protection applications in the State or elsewhere, if applicable

ii. Reason(s) for seeking international protection in the State

iii. Applicant’s country is a safe country of origin, if applicable

iv. Applicant’s fears if returned to country of origin

v. Applicant’s fears on behalf of his or her dependent child or dependent adult, if applicable

SCHEDULE 2

Regulation 4(b)

1. Details of applicant’s identity, including:

i. First name(s) and last name(s)

ii. Country of origin

iii. Nationality/Nationalities

iv. Country/countries for which applicant holds a passport, if applicable

2. Applicant’s status in another EU Member State/safe third country/first country of asylum, including as applicable:

i. Applicant’s international protection status in the Member State/first country of asylum that granted him or her international protection

ii. Applicant’s residence status in the safe third country (visas, work permit)

3. Details of applicant’s living and working conditions in the Member State/safe third country/first country of asylum, as applicable, including:

i. Access to labour market, social welfare and healthcare

ii. Applicant’s family members residing in the Member State/safe third country/first country of asylum

iii. Applicant’s connections to the safe third country

4. Applicant’s reasons for leaving the Member State/safe third country/first country of asylum, as applicable

5. Applicant’s fears regarding his or her return to the Member State/safe third country/first country of asylum, as applicable
