SOCIAL WELFARE (CONSOLIDATED PAYMENTS PROVISIONS) (AMENDMENT) (NO. 4) (FAMILY INCOME SUPPLEMENT) REGULATIONS 2005.  | ||||||
The Minister for Social and Family Affairs, in exercise of the powers conferred on him by section 4 (as amended by section 26 of the Social Welfare and Pensions Act 2005 (No. 4 of 2005)) and 202 of the Social Welfare (Consolidation) Act 1993 (No. 27 of 1993), hereby makes the following regulations:  | ||||||

 Citation and construction.  |    1. (1) These regulations may be cited as the Social Welfare (Consolidated Payments Provisions) (Amendment (No. 4) (Family Income Supplement) Regulations 2005.  | |||||
(2) These regulations and the Social Welfare (Consolidated Payments Provisions) Regulations 1994 to 2005.  | ||||||

 Definitions.  |    2. In these regulations, “the Principal Regulations” means the Social Welfare (Consolidated Payments Provisions Regulations 1994 ( S.I. No. 417 of 1994 ).  | |||||

 Interpretation.  |    3. The Principal Regulations are amended in article 94 bydeleting “other than non-pecuniary emoluments,” in the definition of “earnings from employment”.  | |||||

 Persons regarded as being in remunerative full-time employment.  |    4. The Principal Regulations are amended in article 97 (as substituted by article 4 of the Social Welfare (Consolidated Payments Provisions) (Amendment) (No. 5) Regulations 1996 ( S.I. No. 189 of 1996 )) by the insertion of “, employment under a scheme administered under the aegis of the Minister for Community, Rural and Gaeltacht Affairs and known as the Rural Social Scheme” after “Community Employment”.  | |||||

The Minister for Finance hereby consents to the making of the foregoing regulations.  | ||||||

These regulations provide for including benefit-in-kind in the calculation of earnings from employment for the purposes of Family Income Supplement.  | ||||||
In addition, these regulations also provide that where a person is employed under the Rural Social Scheme they will not be entitled to receive Family Income Supplement.  |
