Ethics in Public Office (Prescribed Public Bodies, Designated Directorships of and Positions in Public Bodies) Regulations 2005

Made by the Minister for Finance

I, BRIAN COWEN, Minister for Finance, in exercise of the powers conferred on me by section 3 of and paragraph (13) of the First Schedule to the Ethics in Public Office Act 1995 (No. 22 of 1995), and, in relation to a body, organisation or group prescribed for the purposes of that paragraph, am of the opinion that, in the public interest and having regard to the provisions and spirit of that Act, such as are specified in the following regulations ought to be prescribed, and after consultation with such other Ministers of the Government as I consider appropriate, hereby make the following regulations:

1. (1) These Regulations may be cited as the Ethics in Public Office (Prescribed Public Bodies, Designated Directorships of and Positions in Public Bodies) Regulations 2005.

(2) These Regulations come into operation on 1 January 2006.

2. The Ethics in Public Office (Prescribed Public Bodies, Designated Directorships of Public Bodies, and Designated Positions in Public Bodies) Regulations 2004 ( S.I. No. 699 of 2004 ) are amended by substituting -

(a) in paragraph 5, “(10) for “(9),

(b) for paragraph 6 the following -

“6. The following are prescribed for the purposes of paragraph 1(13) to the Act -

(a) Advisory Council for English Language Groups - ACELS,

(b) Area Partnerships and Area Development Management funded community groups,

(d) Centre for Early Childhood Development and Education,

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation).

These regulations are made under the Ethics in Public Office Act 1995 (No. 22 of 1995) to apply the provisions of the Act to persons holding or occupying specified directorships and positions in the Public Service (other than in the Civil Service. The Regulations prescribe certain directorships and positions of employment in the Public Service as either “designated directorships” or “designated positions of employment” as referred to in Sections 17 and 18 of the Act, respectively. Persons holding directorships or occupying positions prescribed in these regulations are required to furnish a statement of registrable interests (as defined in the Second Schedule to the Act) to such officer or relevant authority (as defined in Sections 17 and 18 of the Act) as determined by the Minister for Finance. Where no registrable interests exist, a nil statement is requested. Persons holding directorships prescribed as “designated directorships”, are also required to furnish a statement of registrable interests, or, where appropriate, are requested to furnish a statement of nil interests, to the Standards in Public Office Commission.

Details of the officer or relevant authority in each of the public bodies, as determined by the Minister for Finance, will be available in an Appendix to the Standards in Public Office Commission's “Guidelines on Compliance with the Provisions of the Ethics in Public Office Acts 1995 and 2001 - Public Servants (Fourth Edition)”.
