I, DARRAGH O’BRIEN, Minister for Climate, Energy and the Environment, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving effect to Regulation (EU) 2025/40 of the European Parliament and of the Council of 19 December 2024,1 hereby make the following regulations: | ||
Citation | ||
1. These Regulations may be cited as European Union (Packaging and Packaging Waste) (Designation of Competent Authorities) Regulations 2025. | ||
Interpretation | ||
2. (1) In these Regulations— | ||
“Agency” means the Environmental Protection Agency; | ||
“EU Regulation” means Regulation (EU) 2025/40 of the European Parliament and of the Council of 19 December 20241 on packaging and packaging waste, amending Regulation (EU) 2019/10202 and Directive (EU) 2019/9043 and repealing Directive 94/62/EC4 ; | ||
“local authority” has the meaning given to it by section 2 (1) of the Local Government Act 2001 (as amended); | ||
“Minister” means the Minister for Climate, Energy and the Environment. | ||
(2) A word or expression which is used in these Regulations, and which is also used in the EU Regulation, unless the context otherwise requires, has the same meaning in these Regulations as it has in the EU Regulation. | ||
Designation of Competent Authorities | ||
3. (1) The Agency is designated as competent authority responsible for implementation and enforcement of the obligations set out in Articles 53, 54, 56 and 57 of the EU Regulation. | ||
(2) The Minister is designated as competent authority responsible for implementation and enforcement of the obligations set out in Articles 6(10), 29(1) to (7) and (9), 30, 31, 34, 44, 45, 46, 47, 49 and 55 of the EU Regulation. | ||
(3) Each local authority within its functional area is designated as the competent authority responsible for the implementation and enforcement of the obligations set out in Articles 32 and 33 of the EU Regulation. | ||

EXPLANATORY NOTE | ||
(This note is not part of the Statutory Instrument and does not purport to be a legal interpretation.) | ||
The purpose of these Regulations is to designate competent authorities in the State responsible for implementation and enforcement of the obligations set out in Chapter VIII and in Article 6(10), Article 29(1) to (7) and (9) and Articles 30 to 34 of Regulation (EU) 2025/40 of the European Parliament and of the Council of 19 December 2024 on packaging and packaging waste. | ||
