I, MARTIN HEYDON, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving effect to Directive (EU) 2024/1438 of the European Parliament and of the Council of 14 May 20241 , hereby make the following regulations: | ||
Citation and commencement | ||
1. (1) These Regulations may be cited as the European Union (Dehydrated Preserved Milk) (Amendment) Regulations 2025. | ||
(2) These Regulations come into operation on 14 June 2026. | ||
Amendment | ||
2. The European Communities (Dehydrated Preserved Milk) Regulations 2003 ( S.I. No. 298 of 2003 ) are amended– | ||
(a) in Regulation 2(1), by substituting for the definition of “Directive” the following: | ||
“‘Directive’ means Council Directive 2001/114/EC of 20 December 20012 , as amended by Council Directive 2007/61/EC of 26 September 20073 , and Directive (EU) 2024/1438 of the European Parliament and of the Council of 14 May 2024;”, and | ||
(b) in Regulation 5, by substituting for paragraph (2) the following paragraph: | ||
“(2) A person may continue to place on the market products labelled before 14 June 2026, which are in conformity with the European Communities (Dehydrated Preserved Milk) Regulations 2003 before the commencement of the European Union (Dehydrated Preserved Milk) (Amendment) Regulations 2025, until stocks are exhausted.”. | ||
Food Legislation | ||
3. These Regulations shall be deemed to be food legislation for the purposes of the Food Safety Authority of Ireland Act 1998 (No. 29 of 1998). | ||

EXPLANATORY NOTE | ||
(This note is not part of the Instrument and does not purport to be a legal interpretation.) | ||
The purpose of these Regulations is to give legal effect to Council Directive 2001/114/EC of 20 December 2001, as amended by Directive (EU) 2024/1438 of the European Parliament and of the Council of 14 May 2024 which prescribes, and harmonises within the European Union, standards for the composition and labelling of partly or totally dehydrated milk. | ||
These Regulations should be read in conjunction with Directive 2001/114/EC as amended by Council Directive 2007/61/EC of 26 September 2007 and amending Directive (EU) 2024/1438. | ||
