BLUE WHITING (CATCH REPORTING) REGULATIONS 2007

Notice of the making of this Statutory Instrument was published in “Iris Oifigiúil” of 16th February, 2007.

I, JOHN BROWNE, Minister of State at the Department of Communications, Marine and Natural Resources, in exercise of the powers conferred on me by section 15 of the Sea-Fisheries and Maritime Jurisdiction Act 2006 (No. 8 of 2006), and the Marine (Delegation of Ministerial Functions) (No. 2) Order 2006 (No. 167 of 2006), hereby make the following Regulations:

1. These Regulations may be cited as the Blue Whiting (Catch Reporting) Regulations 2007.

2. These Regulations shall come into force on 17 February 2007.

3. In these Regulations—

“blue whiting” means Micromesistius poutassou;

“specified area” means waters falling within ICES sub-areas I, II, III, IV, V, VI, VII, VIIIa, VIIIb, VIIId, VIIIe, XII and XIV (EC and international waters) as they are defined in Regulation (EEC) No. 3880/91 of 17 December 1991 1 , as amended.

4. (1) The master of an Irish sea-fishing vessel shall notify the North West Regional Sea-Fisheries Control Manager of the Sea-Fisheries Protection Authority as soon as the quantity of blue whiting taken in the specified area and retained on board that vessel reaches 500 tonnes.

(2) The Master of such a vessel shall also notify the North West Regional Sea-Fisheries Control Manager of the Sea-Fisheries Protection Authority as soon as each subsequent 500 tonnes is so taken.

(3) For the purposes of paragraphs (1) and (2) of this Regulation, the notification may be made in written form, to fax number +353 749731819, or orally by phone, to phone number +353 74971264.

5. (1) The master of an Irish sea-fishing boat shall give at least four hours’ notice to a sea-fisheries protection officer of his intention to enter port for the purposes of landing blue whiting at a port or landing place in the State or at a landing place outside the State. The master shall provide the following information:

(a) the name of the vessel;

(b) the name of the port or landing place;

(c) the estimated time of arrival at the port or landing place; and

(d) the quantities in kilograms (live weight) of blue whiting on board.

(2) For the purposes of paragraph (1) of this Regulation, the master of an Irish sea-fishing boat shall give the required information to the Fisheries Monitoring Centre in written form, to fax number +353 21 437 8096, or orally by phone, to phone number +353 21 437 8752.

6. If so requested by a sea-fisheries protection officer, the master of an Irish sea-fishing boat shall not land blue whiting at any port or landing place unless on each occasion a sea-fisheries protection officer has given prior approval of the landing.

The effect of these Regulations is to establish additional catch reporting requirements for all Irish sea-fishing boats fishing for blue whiting.
