EUROPEAN COMMUNITIES (PLASTICS AND OTHER MATERIALS) (CONTACT WITH FOOD) (AMENDMENT) REGULATIONS 2007.

Notice of the making of this Statutory Instrument was published in “Iris Oifigiúil” of 2nd March, 2007.

I, MARY COUGHLAN, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving full effect to Commissions Regulation (EC) No. 2023/2006 of 22 December 2006 1 , hereby make the following regulations—

1. These Regulations may be cited as the European Communities (Plastic and other materials) (Contact with food) (Amendment) Regulations 2007 and come into operation on 1 August 2008.

2. The European Communities (Plastic and other materials) (Contact with food) Regulations 2006 ( S.I. No. 139 of 2006 ) are amended—

(a) by the substitution, for Regulation 2(2) (as amended by the European Communities (Plastics and other materials) (Contact with food) (Amendment) Regulations 2006 (S.I. 566 of 2006)), of—

“2 (2) A word or expression that is used in the cellulose film Directive,

the ceramics Directive, the epoxy derivative Regulation, the framework Regulation, the plastics Directive, the teats and soothers Directive, the vinyl chloride Directive or Commission Regulation (EC) No. 2023/2006 of 22 December 2006 that is also used in these Regulations has, in these Regulations, the same meaning as in the act of the institutions of the European Communities in which the word or expression occurs,”, and

(b) by the substitution, for Regulations 13(1) (amended by the European Communities (Plastics and other materials) (Contact with food) (Amendment) Regulations 2006 ( S.I. No. 566 of 2006 )), of—

“13 (1) A person who, by act or omission, contravenes—

(a) Article 3, 4, 15, 16(1) (subject to Article 27) or 17 of the framework Regulation,

(b) Article 2, 3, 4 or 5 of the epoxy Regulation (EC) No. 2023/2006 of 22 December 2006, or

(c) Regulation 3, 4, 5, 5A, 6, 7 or 12 of these Regulations, commits an offence is liable on summary conviction to a fine not exceeding €5,000 or to imprisonment for a period not exceeding 6 months or to both.”.

These Regulations further amends S.I. 139 of 2006 on Plastics and Other Material (Contact with Food). They lay down certain obligations on business operators to introduce good manufacturing practices for material and articles intended to come into contact with food.
