HEALTH (REPAYMENT SCHEME) (PUBLIC NOTICE) REGULATIONS 2007

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 23rd March, 2007.

I, MARY HARNEY, Minister for Health and Children, in exercise of the powers conferred on me by section 20 of the Health (Repayment Scheme) Act 2006 (No. 17 of 2006), hereby make the following Regulations:

Citation.

1. These Regulations may be cited as the Health (Repayment Scheme) (Public Notice) Regulations 2007.

Information to be publicly available if prescribed repayment is made after death of relevant person.

2. (1) Where a prescribed repayment in respect of a recoverable health charge is made after the death of the relevant person (and whether or not a grant of representation has issued in respect of the estate of the relevant person), the Executive shall, as soon as is practicable after such repayment has been made, ensure that the relevant information is available for inspection (whether in paper or electronic form)—

(a) at the offices of the Executive (or of such other place or places as the Executive publicly specifies for the purposes of these Regulations), and at all reasonable times, by members of the public, and

(b) for at least the period of 2 years immediately following the date on which the relevant information is so made available.

(2) In this section, “relevant information”, in relation to a prescribed repayment in respect of a recoverable health charge made after the death of the relevant person, means—

(a) the name and last known address of the relevant person,

(b) the name and last known address of the person to whom such repayment was made, and

(c) the amount of such repayment and the date on which it was made.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation).

These Regulations are made under section 20 of the Health (Repayment Scheme) Act 2006 and provide for the establishment of a public register to record the amount of repayment made in respect of a deceased relevant person. The register which will be maintained by the Health Service Executive will provide accountability in the administration of estates and will be open to inspection by next of kin and the public at large.
