EUROPEAN COMMUNITIES (MOTOR VEHICLES UN – ECE TYPE APPROVAL) (AMENDMENT) REGULATIONS 2007

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 17th July, 2007.

I, NOEL DEMPSEY, Minister for Transport, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving further effect to Council Decision 97/836/EC of 27 November 1997 1 in so far as it relates to the type approval of motor vehicles, trailers and components, hereby make the following regulations—

1. These Regulations may be cited as the European Communities (Motor Vehicles UN-ECE Type Approval) (Amendment) Regulations 2007.

2. The European Communities (Motor Vehicles UN-ECE Type Approval) Regulations 2000 ( S.I. No. 147 of 2000 ) are amended by substituting for the Schedule the following Schedule:

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation)

The European Communities (Motor Vehicles UN-ECE Type Approval) Regulations 2000 ( S.I. No. 147 of 2000 ) gave effect to Council Decision 97/836/EEC of 27 November 1997 which provided for accession by the European Community to the Revised UN/ECE 1958 Agreement on motor vehicle type approval.

The 2000 regulations made provision for national administrative arrangements for the granting of type approval for a motor vehicle, component or part based on the UN/ECE regulations listed in the Schedule to the Regulations.

These Regulations amend the 2000 Regulations by the substitution of a revised Schedule for the original Schedule attached thereto. The revised Schedule adds additional UN/ECE Regulations which have been adopted by the EU subsequent to Council Decision 97/836/EEC. These are regulations 13H, 55, 67, 94, 95 and 104 to 124 inclusive.

Under EU motor vehicle type- approval law approvals under specified UN/ECE regulations may be recognised as alternative approvals to approvals under equivalent EU type- approval directives.
