QUALIFICATIONS (EDUCATION AND TRAINING) ACT 1999 (SECTION 31) REGULATIONS 2007

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 10th August, 2007.

I, MARY HANAFIN, T.D., Minister for Education and Science, in exercise of the powers conferred on me by section 31 of the Qualifications (Education and Training) Act 1999 (No. 26 of 1999), hereby make the following regulations:

1. These regulations may be cited as the Qualifications (Education and Training) Act 1999 (Charter) Regulations 2007.

2. In these regulations—

“Act of 1999” means the Qualifications (Education and Training) Act 1999 (No. 26 of 1999);

“institution” means a recognised institution which has authority to make awards delegated to it under section 29 of the Act of 1999.

3. The following matters are specified for the purposes of section 31 of the Act of 1999 as matters to be included by an institution in a charter referred to in section 31:

(a) the institution’s arrangements for consultation and co-operation—

(i) within the institution, and

(ii) with the community (including commercial and industrial interests in the community) in the region served by the institution,

and such arrangements shall include information relating to the process of consultation and co-operation, including information as to—

(I) how often the consultation process shall be carried out,

(II) the persons or groups who shall be invited to participate in the consultation process, and

(III) the manner and the period of time in which notice of the consultation process shall be given to the persons or groups concerned,

(b) the criteria to be used by the institution for determining the level of demand for particular programmes of education and training and such criteria shall include details of the academic levels of such programmes,

(c) details of the institution’s policy in relation to adult and continuing education, including details of—

(i) its teaching and research facilities,

(ii) its full-time, part-time, evening and distance learning courses,

(iii) its programme for life long learning, and

(iv) the awards which may be made by the institution,

(d) a statement of the institution’s commitment in relation to quality assurance of its programmes of education and training and such statement shall include details of its procedures for the assessment of learners for the purposes of complying with the standards determined by the Higher Education and Training Awards Council,

(e) the institution’s arrangements for the implementation of procedures for access, transfer and progression determined by the Authority by section 8(2)(d) of the Act of 1999,

(f) the institution’s arrangements for the promotion and use of the Irish language and the promotion of the distinctive cultures of Ireland, and

(g) a reference to the consultation process that was carried out pursuant to section 31(4).
