RULES OF PROCEDURE (DEFENCE FORCES) (FORM OF OATH OF MILITARY JUDGE) 2007

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 2nd October, 2007.

I, WILLIE O’DEA, Minister for Defence, in exercise of the powers conferred on me by section 240 (as amended by the Defence (Amendment) Act 2007 (No. 24 of 2007)) of the Defence Act 1954 (No. 18 of 1954), hereby make the following rules:

1. These Rules may be cited as the Rules of Procedure (Defence Forces) (Form of Oath of Military Judge) 2007.

2. These Rules come into operation on 25 September 2007.

3. The form of oath to be taken or solemn declaration to be made by a military judge before entering upon his or her duties under the Defence Act 1954 (No. 18 of 1954) shall be as follows:

“I, , swear by Almighty God (or — do solemnly and sincerely promise and declare — as the case may be) that I will duly and faithfully and to the best of my knowledge and power execute the office of military judge in accordance with the Defence Act 1954 and the Rules of Procedure made thereunder without partiality, fear or favour, affection or ill-will towards any person, and that I will uphold the Constitution and the laws.”.

These Rules provide for the form of oath to be sworn or the solemn declaration to be made by a military judge before entering upon his or her duties under the Act, as required by section 184L(7) of the Defence Act 1954 .
