BRUCELLOSIS IN CATTLE (GENERAL PROVISIONS) (AMENDMENT) ORDER 2007

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 5th October, 2007.

I, MARY COUGHLAN, Minister for Agriculture and Food, in exercise of the powers conferred on me by sections 3, 27 and 48 of the Diseases of Animals Act 1966 (No. 6 of 1966), as amended by the Diseases of Animals (Amendment) Act 2001 (No. 3 of 2001) (as adapted by the Agriculture, Food and Rural Development (Alteration of Name of Department and Title of Minister) Order 2002 (S. I. No. 306 of 2002), hereby order as follows—

1. This Order may be cited as the Brucellosis in Cattle (General Provisions) (Amendment) Order 2007.

2. The Brucellosis in Cattle (General Provisions) Order 1991 ( S.I. No. 114 of 1991 ) is amended—

(a) by the substitution, for Article 5(3)(a), of—

“(a) the owner or person in charge of the herd shall present for the taking of samples those eligible animals in the herd required by the Minister to be tested.”

(b) by the substitution, for Article 5(3)(f), of—

“(f) where samples have been taken from all those eligible animals in a herd required to be tested, no female animal of any age or bull aged 12 months or more shall be moved out of the herd or off the land on which the samples were taken, except under and in accordance with the terms of a movement permit, until the tests have been completed and either the owner or the person in charge of the animals have been informed of the results of the tests”,

and

(c) by the substitution, for the First Schedule, of—

“FIRST SCHEDULE

Article 5(2)(b)

Declaration of Presentation of Animals and Surrender of Identity Cards.

*The.................. animals presented by me this day for testing under the above Order at................. are the only animals in my possession or under my control in Dealer/Herd Number*.................... which are required to be tested under the Order.

I have surrendered all the identity cards....................................... in my possession to the testing veterinary surgeon/authorised officer*.

Note: Refusal or failure to give information or the wilful or negligent giving of false or misleading information is an offence under Section 48 of the Diseases of Animals Act 1966 .”
