EUROPEAN COMMUNITIES (PHYTOSANITARY MEASURES) (SUDDEN OAK DEATH) (AMENDMENT) REGULATIONS 2007

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 5th October, 2007.

I, MARY COUGHLAN, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving effect to Commission Decision 2007/201/EC of 27 March 2007 1 , hereby make the following Regulations—

1. These Regulations may be cited as the European Communities (Phytosanitary Measures) (Sudden Oak Death) (Amendment) Regulations 2007.

2. The European Communities (Phytosanitary Measures) Regulations 2004 ( S.I. No. 578 of 2004 ) are amended in Regulation 2(1) by substituting for the definition of ‘Commission Decision’ the following—

“ ‘Commission Decision’ means Commission Decision No. 2002/757/EC of 19 September 2002 as amended by Commission Decision No. 2004/426/EC of 29 April 2004 and Commission Decision No. 2007/201/EC of 27 March 2007;”.

These Regulations transpose provisional emergency phytosanitary measures to prevent the introduction and spread of Phytophthora ramorum Werres, De Cock & Man in’t Veld sp.nov. (Sudden Oak Death).
